LO2: Legal and Ethical Issues

Legal means in relation to our promo that the video shoot is carried out with the correct documents and the band has gave us full permission of using the footage we capture
 One legal issue that can be addressed is the release and consent forms for the Squarewave music video. This allows us to release all content that we film with the band is allowed to be seen by others. We can deal with this by making the band sign a release and consent form that allows us to film them. Another Legal issue would be copyright. As the band is independent we would have to have direct conformation that we a re allowed to use their assets including their song. We would have to involve PRS, this is to make sure that the band get all the royalties from the music videoAn ethical issue is an issue that is of the same importance as legal, however it may be in law it is morally as important. this priorities issues like racial abuse and sexism. Another ethical issue would be making sure the actors or band members feel comfortable.
Another Legal issue example we would have to think of is the PRS. This making sure the gain royalties from the music video. To make sure no legal action is taken against us we will tell Squarewave that we will be posting the video on our page and that all royalties will be theirs.

Ethical mean Ethical means in relation to out promotion is that everyone feels comfortable and nobody is offended or hurt by the footage. An example of this would be one of us filming making one of the band members feel uncomfortable by being too bossy or showing the band in a deceiving way. For example if we film them and edit it to make the band look bad and they weren't. Then that would be ethically wrong.We would have to address this problem by ensuring that they okay with the footage and we are not too bossy when telling them the shot types we want. Due to the band and the actors being white in the music video they are reinforcing a sub culture of indie culture. The representation of people shown in the video are shown as indie and edgy to match the type of song and the band. There int going to be any other actors of different backgrounds in the video because we are using the stereotypical sub culture of the genre of music.
OfCom is the office of communications that regulate telecommunications, TV and radio. 
BBFC is the British board of film certificates. They regulate the age rating on films they have specific guidelines to ensure that the age rating will not be too harsh or scary for them. The age certificate that our promo would receive would be PG because they will be no violence, no drinking and no swearing. We will be adhering to the guidelines of BBFC and OFcom because they will be no parts of the music video that will be concerning or not allowed. 
Ofcom is the office of communication that regulate telecommunications, TV and radio. 
They are relevant based on our promo being distributed online because within the telecommunications section of their regulation it includes internet. With the video being posted online makes them apart of there regulators. W3C wouldn't be helpful in this situation because they give advice to companies and business about what they are posting online and not regulating and taking things off the internet. OFcom would regulate them by ensuring the video was suitable for the age we had put it for and if a complaint had been placed about it they would investigate- either taking it down or asking us to change the age certificate of the song. 
Based on our music video people could be misrepresented by showing indie fans and edgy people as trouble makers or as people that wonder in random abandoned places. No places would be misrepresenting because we are not changing anything in any locations we are using however we are still using public places that show Sheffield with all of its skyline and greenery, this wouldn't show Sheffield in a misrepresenting way. For example showing solution from buildings and the bad quality of the streets.
Based on out music video we would have to get copy right permission from the band "sqaurewave" so we can use their band name. We would have to get permission before filming to ensure that we have all the resources we need for the editing section of post production. There band name will be used at the start of the music video to tell the audience who the song is by and the name of the song. 
When the music video has finished and is distributed to youtube or Vimeo the band may ask for the royalties of the music video. This would be classed as intellectual property because we have produced and created the video for the band with their permission but the royalties would be the money they make from the video. 
  The purpose of the music video is to promote the band and their new music. With them regularly performing at Cafe Totem and them having their own youtube, the music video will add to their collect of other music videos but promote the band further. We will create the product to promote the band by including their youtube, social media and band name at the end of the video to get them more coverage on different platforms. On them different platforms they will be able to gain more fans and potential people to go to their gigs. The overall aim to make Squarewave more popular from this and allow them to further their career through this.
